This year's CHCA Legal Symposium focuses on Mediation and Arbitration for nursing home and assisted living facility administrators, managers, and other personnel involved in initiating and implementing these arrangements in their facilities. The program will begin with a short presentation on the legal background of mediation and arbitration under the requirements of Colorado's unique Health Care Availability Act. This will include an introduction on the similarities and differences between mediation and arbitration and what provisions are both legally required and otherwise desirable to be in a written agreement with residents and their legal representatives.
Then, the program will turn to three "nuts and bolts" sessions. The first will be an interactive presentation on how to effectively explain and present an arbitration/mediation agreement to residents, their families and/or legal representatives upon admission to the facility. The second will be a primer on preparing for and participating in settlement mediation of health care disputes presented by a recognized Colorado mediator. The third will be a session on the arbitration process and what to expect when the health care disputes proceeds to this adjudication process.
The program will then close with a point/counterpoint discussion concerning public policy and practical standpoint. Participants will include representation of both sides of the issue from the legislative and legal arenas.
